Druh pr\u00e1ce vymezuje okruh pracovn\u00edch \u00fakol\u016f, ke kter\u00fdm se zam\u011bstnanec zavazuje. Jin\u00e9 druhy pr\u00e1ce, ne\u017e ty, kter\u00e9 jsou sjedn\u00e1ny v pracovn\u00ed smlouv\u011b nen\u00ed zam\u011bstnanec povinen vykon\u00e1vat. Jedinou v\u00fdjimkou jsou p\u0159\u00edpady dle \u00a7 41 z\u00e1kon\u00edku pr\u00e1ce, kdy je umo\u017en\u011bno zam\u011bstnavateli v\u00fdjime\u010dn\u011b p\u0159ev\u00e9st zam\u011bstnance na jinou pr\u00e1ci. Druh pr\u00e1ce m\u016f\u017ee b\u00fdt sjedn\u00e1n velmi specificky nebo obecn\u011b, ale nem\u011bl by b\u00fdt vymezen tak \u0161iroce, aby bylo zam\u011bstnanci mo\u017eno p\u0159id\u011blovat jakoukoliv pr\u00e1ci. Nen\u00ed p\u0159ek\u00e1\u017ekou, pokud je v pracovn\u00ed smlouv\u011b uvedeno v\u00edce druh\u016f pr\u00e1ce. Sjednan\u00fd druh pr\u00e1ce vy\u017eaduje bli\u017e\u0161\u00ed popis pracovn\u00edch \u00fakol\u016f pro jednotliv\u00e9 zam\u011bstnance tzv. n\u00e1pl\u0148 pr\u00e1ce. N\u00e1pl\u0148 pr\u00e1ce je jednostrann\u00fd p\u0159\u00edkaz zam\u011bstnavatele, kter\u00fdm se zam\u011bstnanci vymezuj\u00ed jednotliv\u00e9 \u00fakoly v\u00a0r\u00e1mci sjednan\u00e9ho druhu pr\u00e1ce.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-409fff72c3d91da978e756e2d550e77a\"><strong>M\u00edsto nebo m\u00edsta v\u00fdkonu pr\u00e1ce, <\/strong>ve kter\u00fdch m\u00e1 b\u00fdt pr\u00e1ce vykon\u00e1v\u00e1na. P\u0159elo\u017eit zam\u011bstnance k\u00a0v\u00fdkonu pr\u00e1ce do jin\u00e9ho m\u00edsta je mo\u017en\u00e9 pouze se souhlasem zam\u011bstnance! M\u00edsto v\u00fdkonu pr\u00e1ce m\u016f\u017ee b\u00fdt ur\u010deno adresou konkr\u00e9tn\u00edho pracovi\u0161t\u011b nebo jen ozna\u010den\u00edm obce, stejn\u011b jako m\u016f\u017ee b\u00fdt ur\u010deno velmi \u0161iroce nap\u0159.: \u00fazem\u00ed \u010cesk\u00e9 republiky. Pokud nen\u00ed ur\u010deno konkr\u00e9tn\u011b, mus\u00ed b\u00fdt ur\u010deno m\u00edsto pravideln\u00e9ho pracovi\u0161t\u011b, pro \u00fa\u010dely cestovn\u00edch n\u00e1hrad v p\u0159\u00edpad\u011b slu\u017eebn\u00ed cesty.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-575f25dabf709b4fac776770c2fb43ad\"><strong>Den n\u00e1stupu do pr\u00e1ce.<\/strong> V\u00a0den n\u00e1stupu do pr\u00e1ce vznikne pracovn\u00ed pom\u011br. Ode dne n\u00e1stupu do pr\u00e1ce m\u00e1 zam\u011bstnanec povinnost pr\u00e1ci vykon\u00e1vat a\u00a0zam\u011bstnavatel povinnost pr\u00e1ci p\u0159id\u011blovat. Jako den n\u00e1stupu lze sjednat i den pracovn\u00edho klidu &#8211; nap\u0159. 1.leden (st\u00e1tn\u00ed sv\u00e1tek). Nenastoup\u00ed-li zam\u011bstnanec ve sjednan\u00fd den do pr\u00e1ce, ani\u017e by mu v\u00a0tom br\u00e1nila p\u0159ek\u00e1\u017eka v\u00a0pr\u00e1ci, nebo se zam\u011bstnavatel do t\u00fddne (\u00a7 350a) nedozv\u00ed o\u00a0t\u00e9to p\u0159ek\u00e1\u017ece, m\u016f\u017ee zam\u011bstnavatel od pracovn\u00ed smlouvy odstoupit. Od pracovn\u00ed smlouvy je mo\u017en\u00e9 odstoupit, jen dokud zam\u011bstnanec nenastoupil do pr\u00e1ce. Pro odstoupen\u00ed od pracovn\u00ed smlouvy se vy\u017eaduje dodr\u017een\u00ed p\u00edsemn\u00e9 formy, jinak se k\u00a0n\u011bmu nep\u0159ihl\u00ed\u017e\u00ed.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading has-black-color has-text-color has-link-color wp-elements-a54eda727d147a9e6a8ffc82cb4c7062\">D\u00e1le lze v pracovn\u00ed smlouv\u011b sjednat:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-9cc5e8e33ebd357a01e0750a0800ca65\"><strong>Zku\u0161ebn\u00ed doba<\/strong> &#8211; nesm\u00ed b\u00fdt del\u0161\u00ed ne\u017e 3 po sob\u011b jdouc\u00ed m\u011bs\u00edce. U vedouc\u00edch pracovn\u00edku 6 po sob\u011b jdouc\u00edch m\u011bs\u00edc\u016f. (m\u011blo by doj\u00edt k \u00faprav\u011b od dubna roku 2025, po\u010dk\u00e1me na schv\u00e1len\u00ed..).<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-c9867203c9ec7db89826cd36649f77f6\"><strong>V\u00fd\u0161e mzdy<\/strong> &#8211; v\u011bt\u0161inou upravena mzdov\u00fdm v\u00fdm\u011brem.<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-56c28bb82e021f6bccd333babc585bd1\"><strong>Krat\u0161\u00ed t\u00fddenn\u00ed pracovn\u00ed dobu<\/strong> (tzv. \u010d\u00e1ste\u010dn\u00fd \u00favazek).<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-5593cb82f93a64b578306b76bdaa9231\"><strong>Doba trv\u00e1n\u00ed pracovn\u00edho pom\u011bru<\/strong> &#8211; pokud je sjednan\u00e1 na dobu ur\u010ditou, mus\u00ed b\u00fdt jasn\u011b uvedeno, kdy skon\u010d\u00ed a naopak za jak\u00fdch podm\u00ednek m\u016f\u017ee b\u00fdt prodlou\u017eena. Pracovn\u00ed pom\u011br na dobu ur\u010ditou mezi t\u00fdmi\u017e \u00fa\u010dastn\u00edky lze sjednat jen na dobu, kter\u00e1 nesm\u00ed p\u0159es\u00e1hnout 3 roky a m\u016f\u017ee b\u00fdt ode dne vzniku opakov\u00e1n nejv\u00fd\u0161e dvakr\u00e1t. Za opakov\u00e1n\u00ed pracovn\u00edho pom\u011bru na dobu ur\u010ditou se pova\u017euje i&nbsp;jeho prodlou\u017een\u00ed (nap\u0159. dodatkem).<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-8ca6574bca0bc89fa45fb4d647e19941\"><strong>Dovolen\u00e1 <\/strong>&#8211; zejm\u00e9na pokud je del\u0161\u00ed, ne\u017e z\u00e1konem stanoven\u00e9 4 t\u00fddny.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-88296901e91b650c9d981cd775e03e39\">Podm\u00ednky sjednan\u00e9 v&nbsp;pracovn\u00ed smlouv\u011b lze m\u011bnit jen dohodou smluvn\u00edch stran. Proto i&nbsp;pokud je v&nbsp;pracovn\u00ed smlouv\u011b sjedn\u00e1no nap\u0159\u00edklad konkr\u00e9tn\u00ed rozvr\u017een\u00ed pracovn\u00ed doby, je takov\u00e9 rozvr\u017een\u00ed pracovn\u00ed doby z\u00e1vazn\u00e9 a zam\u011bstnavatel nem\u016f\u017ee pracovn\u00ed dobu jednostrann\u011b proti v\u016fli zam\u011bstnance rozvrhnout jinak.<\/p>\n\n\n\n<p>POZOR. Zam\u011bstnavatel, kter\u00fd poru\u0161\u00ed stanoven\u00e9 povinnosti p\u0159i vzniku pracovn\u00edho pom\u011bru se dopou\u0161t\u00ed p\u0159estupku podle p\u0159\u00edslu\u0161n\u00fdch ustanoven\u00ed z\u00e1kona o&nbsp;inspekci pr\u00e1ce a m\u016f\u017ee mu za to b\u00fdt ulo\u017eena pokuta od 200 000 K\u010d (nap\u0159. poru\u0161en\u00ed informa\u010dn\u00ed povinnosti) do 10 000 000 K\u010d (pro zvl\u00e1\u0161\u0165 z\u00e1va\u017en\u00e9 jedn\u00e1n\u00ed). <\/p>\n\n\n\n<p><\/p>","protected":false},"excerpt":{"rendered":"<p>N\u00e1le\u017eitosti pracovn\u00ed smlouvy, dle z\u00e1kon\u00edku pr\u00e1ce: Krom\u011b toho, \u017ee jsou v pracovn\u00ed smlouv\u011b uvedeny identifika\u010dn\u00ed \u00fadaje obou stran (zam\u011bstnanec x zam\u011bstnavatel), mus\u00ed pracovn\u00ed smlouva obsahovat pouze t\u0159i podstatn\u00e9 n\u00e1le\u017eitosti dle \u00a7 34 odst. 1 z\u00e1kon\u00edku pr\u00e1ce.
